1. Acceptance of Terms

Continued use of the Services following such updates constitutes your acceptance of the revised Terms.

To use PragmaAI, you must be at least eighteen (18) years of age or the minimum legal age required to enter binding agreements under the laws of your jurisdiction. By using the Services, you represent and warrant that:

  • You meet the applicable legal age requirement;
  • You possess the legal authority to enter into these Terms;
  • Any registration information you provide is accurate and complete.

PragmaAI does not knowingly permit use by minors. Parents and guardians are responsible for supervising unauthorized use by underage individuals and may contact us if they believe a minor has accessed the platform improperly.

3. Description of Services

PragmaAI provides users with access to AI-powered digital tools designed to assist with conversational tasks, productivity, information discovery, research, creative generation, collaboration, and other evolving capabilities. Services may include, but are not limited to:

  • AI chat interfaces;
  • Search and research functionality;
  • Web-assisted responses;

PragmaAI continuously develops and refines its Services. As such, features may be added, modified, restricted, or removed at our sole discretion. They are not intended to replace licensed professional advice in legal, financial, medical, or emergency matters.

4. Nature and Limitations of Artificial Intelligence Services

PragmaAI utilizes artificial intelligence systems, machine learning technologies, and large language models to generate automated responses based on user prompts and available data sources. While we strive to offer useful and innovative technology, you acknowledge and agree that:

  • AI-generated responses may contain inaccuracies, omissions, or outdated information;
  • Outputs may vary significantly based on phrasing, context, and technical limitations;
  • Responses are probabilistic and automated in nature;
  • Human review of outputs is not guaranteed;
  • Certain content may occasionally be flawed, incomplete, or unsuitable.

You accept full responsibility for independently evaluating and verifying any information obtained through the Services before relying on it. PragmaAI expressly disclaims liability for losses, damages, or consequences arising from decisions made based on AI-generated content.

5. User Accounts, Registration, and Security

Access to certain Services may require account registration. You agree to provide accurate, current, and complete registration information and to maintain such information as necessary. You are solely responsible for:

  • Safeguarding login credentials;
  • Maintaining account confidentiality;
  • Monitoring account usage;
  • Ensuring all activities under your account comply with these Terms.

You must promptly notify PragmaAI of any suspected unauthorized access, security breach, or misuse of your account. PragmaAI reserves the right to suspend, restrict, or terminate accounts where we reasonably believe there has been:

  • Fraudulent activity;
  • Abuse of Services;
  • Security compromise;
  • Violation of applicable laws;
  • Breach of these Terms.

6. Subscription Plans, Billing, and Payment Terms

Certain PragmaAI Services may require payment through subscription plans, premium upgrades, add-on packages, or limited trial offers. By purchasing any paid Service, you authorize PragmaAI or its designated payment processors to charge your selected payment method according to the applicable billing cycle. Subscription structures may include:

  • Trial plans;
  • Monthly subscriptions;
  • Quarterly subscriptions;
  • Premium tiers;
  • Feature-specific upgrades.

Unless otherwise stated:

  • Trial subscriptions automatically convert into paid plans unless canceled before the applicable deadline;
  • Subscription fees renew automatically;
  • Pricing may vary by location, taxes, payment provider, or promotional offers;
  • Fees are generally non-refundable except where required by law.

Users are solely responsible for monitoring billing cycles, renewal dates, and cancellation deadlines. PragmaAI may revise pricing, plan structures, or service availability with reasonable prior notice.

7. Cancellation and Refund Policy

You may cancel subscriptions at any time through designated account or billing settings. To prevent future billing, cancellation must be completed before the renewal deadline. Cancellation will generally become effective at the end of the current billing period. Except where mandated by applicable law:

  • Payments are non-refundable;
  • Partial billing periods are not prorated;
  • Failure to use Services does not entitle users to refunds;
  • Payment disputes or chargebacks do not constitute valid cancellation.

PragmaAI reserves the right to enforce cancellation procedures and billing protections to prevent abuse.

8. User Conduct and Acceptable Use

Users agree to use PragmaAI lawfully, ethically, and responsibly. You may not use the Services to:

  • Violate laws or regulations;
  • Commit fraud or deceptive practices;
  • Generate harmful, abusive, or exploitative material;
  • Disseminate hate speech, harassment, or violent content;
  • Create misinformation campaigns;
  • Engage in cyber abuse, malware distribution, or unauthorized automation;
  • Reverse engineer proprietary technology;
  • Use outputs to train competing AI systems without authorization.

Violations may result in immediate suspension, account termination, legal action, or reporting to relevant authorities.

9. Intellectual Property Rights

All rights, title, and interest in the PragmaAI platform, including software, models, algorithms, trademarks, branding, interfaces, and proprietary technologies, remain exclusively owned by PragmaAI Inc. or its licensors. Users retain ownership of their submitted content (“User Input”) but grant PragmaAI a limited, non-exclusive license to process such content for:

  • Service provision;
  • Operational security;
  • Legal compliance;
  • Platform improvement.

You may not copy, distribute, resell, exploit, or create derivative works from proprietary platform elements without prior written authorization.

10. Data Privacy and Security

PragmaAI values privacy and implements commercially reasonable safeguards to protect user information. Our data practices may align with relevant regulatory standards, including:

  • India’s Digital Personal Data Protection Act (DPDP);
  • General Data Protection Regulation (GDPR);
  • California Consumer Privacy Act (CCPA);
  • Other applicable local laws.

By using the Services, you consent to the collection, processing, storage, and use of information in accordance with our Privacy Policy. While we implement security measures, no digital system is entirely immune from risks, and users acknowledge such inherent limitations.

11. Service Modifications and Availability

PragmaAI provides Services on an “as available” and “as is” basis. We reserve the right, at any time and without liability, to:

  • Modify features;
  • Limit functionality;
  • Adjust pricing;
  • Suspend operations;
  • Remove products or tools.

Temporary interruptions, maintenance, technical failures, or third-party disruptions may occur.

12. Disclaimer of Warranties

To the fullest extent permitted by law, PragmaAI disclaims all warranties, express or implied, including but not limited to:

  • Merchantability;
  • Fitness for a particular purpose;
  • Accuracy;
  • Reliability;
  • Availability;
  • Non-infringement.

We do not guarantee uninterrupted, error-free, or fully accurate Services.

13. Limitation of Liability

To the maximum extent permitted by law, PragmaAI and its affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:

  • Service usage;
  • Inability to access Services;
  • AI-generated outputs;
  • Billing disputes;
  • Third-party integrations;
  • Security incidents.

Your sole remedy for dissatisfaction is discontinuation of the Services.

14. Indemnification

You agree to indemnify, defend, and hold harmless PragmaAI, its affiliates, employees, officers, and licensors against claims, losses, damages, liabilities, and expenses arising from:

  • Your misuse of the Services;
  • Legal violations;
  • Intellectual property infringement;
  • Fraudulent or harmful conduct;
  • Improper use of generated outputs.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the applicable laws of PragmaAI’s operating jurisdiction, subject to mandatory local consumer protections where legally required. Disputes may be resolved through:

  • Individual arbitration;
  • Competent courts in New Delhi, India.
  • Alternative dispute resolution procedures.
